It depends on what typw of prescription coverage/insurance that you have and what the drug is! The best thing to do is call our pharmacist and ask them if you have a question about your prescription, they are the only ones that can give you an answer to this question.
Hello willywillis. It depends on the drug. If its a controlled substance the likely hood is slim. Regards pledge
Im calling bs. You haven't a clue what you're talking about
I agree. I want to see facts. Not opinions.
Medicare allows five days before the end of the script period. Around here we get 30 day supplies. Many I get as 90 day supplies.
My pain meds can be 30 or 90 as well. However, I have a doctor who knows that I am responsible, so she writes scripts that way for me to save money.
My old insurance allowed a week before end of script. Yep, call your insurance.
I live in Illinois and just tried to get a refill already approved by both Dr and insurance, insurance also paid and Walgreens wouldn't release. See Walgreens sent automatic refill notice a couple of days before refill date of 12/07
So I checked when last refill was and replied to refill. But because I took a week to pick up was told there was a state law not allow me to pick up my medication until 28 days after the day I picked the medication after I pick the medication up. This has happened more than once with Walgreens. I complied with all the refill requirements. I was not trying to pick up my medication too early. I just picked up my medication 7 days from the notification of being refilled on 12/07. No matter where I look or who I ask I can not find this law that states if you are more than a certain number of days after refill date you have to wait another month to refill. Can anyone help is there a law is there a rule?
The short answer to your question is get as far away from Walgreens as possible. NO, there is no such rule in ANY state, nor is there any such rule under Title 21: www.deadiversion.usdoj.gov/21cfr/cfr/2106cfrt.htm
Walgreens has messed up more than once, with the most recent and worse being one of the Florida locations working with a Dr. as a pill mill. These are internal corporate rules and are, in fact, illegal. First, here are the Federal rules in days:
Sched II: No refills, 90 day multiple prescriptions "do not fill until" permitted, a new prescription cannot be refilled earlier than the 25th day.
Sched III-V 30-90 day supply, max 6 month supply, 7 days before 30 day refills, 22 days (mail order). In other words, let's say you doctor provides a 30 day prescription for a schedule VI with 5 refills, that is the max, or a 90 day with 1 refill. Insurance companies (call your and you'll see) all follow Title 21 Diversion.
The morons at Walgreens have messed up so many times, management has become paranoid, for example: They no longer fill a schedule II until the 28th day, however, they do not count day 1, so it's the 29th day. A schedule III-V is the 27th day, but really the 28th.
I was gathering information on this, and had to visit 3 Walgreens in 3 states. I asked?
If I am prescribed a schedule II on the 1st day of a 30 day month and the physician directs me to take 1 tab PO or orally at 8AM, how many tablets would I have taken in 28 days? Not one pharmacist or employee would reply. It gave me great pleasure to say than you, since I had taken the person name and said, at least when this becomes part of the record, I can say all three stores were employed with consistent idiots.
The other question is a 30 day supply, say a schedule IV, you call in your refill based on their "made up" 28th day and you have 7 tablets left, (whatever the reason does not matter), but your Dr. directed you, that's why you're still have 7. So, you come in say, on the 5th of the following month (7 days after they processed the refill on the 28th). The 5th is the date Walgreens creates a tag on your record as the date of refill. Let's say you visited your Dr. again, and he or she tells you (again, whatever, it does not matter), based on test results, you must take 1 tablet of your schedule IV every day. You walk on the 5th, out of medication, with either a new prescription, or there are refills left and are told you can't refill the prescription, because we go by the date you picked it up.
What you did is listen to your doctor and could not get in on the 28th, or said, you know what, I'll be getting a different medication from your Cardio doc on the 5th, so I may as well save time and fill both that day.
Not at Walgreens. There is only one way and this was done for a reason.
Do the same thing, have Walgreens try to pull the same crap and say, ask for the pharmacist to confirm and when he or she does, ask them for the number your physician can call to speak with you. Their 1st words will be in does not matter, it's our policy. Say, no problem, what's the number.
Then sit down and wait. If your physician calls and tells the pharmacist exactly this:
I have a patient there who needs a legal refill, and I need to know if she will need to wait longer than 5 minutes, since if she does, I will be calling Attorney (whatever name) at the Board of Registration in Pharmacy (every state has a board of Medicine for Drs. and one for Pharmacies) and the Walgreens pharmacist will immediately comply.
BTW, their phone refill system, can't work with the notes they make. The stupid thing calls you and people drive in and when they arrive, that's when they are told they can't pick up their medication.
It is taking some time, but I have heard (can't confirm) there will be a class action suit filed against Walgreens. Unfortunately, it's not really the people in the stores (although some seem to enjoy it) it's the management driving them nuts, because they have had so many problems.
Your best bet: Find an independent mom and pop pharmacy, there has been a surge of new independent pharmacies popping up and they follow Fed and State rules and your insurance company must conform to any state rules, (that's how the small independent work, they don't look at the last date, they enter a refill or new script and if insurance let's it go, they know it's legal).
So, it's not you, it's Walgreens and while CVS and the other large chains don't do the idiotic "your refill is based on the day you pick it up," independants are best.
BTW, another way to tick off Walgreens, is when they pull that, tell them CVS or whomever will be calling, you want your medications transferred out. That is done electronically, so Walgreens can't do anything, if they refuse, you can call the board and do it right in front of them in the store.
Good luck.
Stay away from Walgreens and CVS! They make their own rules!
In response to the comment by femaleon:
Pharmacies do not care about what day the script was submitted, approved, or filled. All pharmacies are required (by law, mind) to approve refills based on the pick up date. For this exact reason...
If you fill something, or your doctor sends something over and you don't pick it up, it makes no sense to record from that day, if your pharmacy is doing this, they are in direct violation of state and federal drug dispensery laws. If your goal is to pick up early avoid Walgreens (for whatever reason you want them eaely, I have issues during the summer, a condition called hyperhidrosis, basically I sweat too much and my patches fall off.
They are meant to last 2 days, so if even one falls off, it's usually a full day loss, and I can only fill one day in advance, so instead of fighting it and looking like I'm just desperate to get meds, I've found ways to keep the patches on, in some cases quite extreme, because the dirty looks you get when you legitimately need a narcotic medication filled early makes a person feel somehow subhuman, why? Because a doctor prescribed me a medication that doesn't work well with a physical issue I have? Or because I am going on vacation for two weeks and couldn't plan my every move around my medication, or is it just because 80% of the people that ask for an early fill are out of their medication and are going through withdrawal?
Yes.Stay away from Walgreens.they SUCK. MOM and POP is the way to go.
I agree with Mac on this one. If you are talking about pain meds, usually you have to wait the full amount of time between your scripts. Mine are written for 28 days so I can reflll on the 28th day. My insurance allows reflls of maintainence prescriptions after 80% is used otherwise. Best to call your pharmacy & ask...
Mine are written for every thirty days, but my pharmacist will give me all of my rx's early if I'm going out of town. I think it does depend on what type of rapport you have with your pharmacist.
I see my pain doc every 3 months, & she gives me two prescriptions at a time. One for current month, & one for next month. She dates them for every 28 days so there is no way I can refill early on oxycodone being a schedule 2 drug. The other I take can be refilled after 80% is used like I said. I believe it depends on your insurance too. Some of our maintainence drugs are written for 90 days & are mail order in accordance to our insurance. Gee, I can't wait til Jan. 1st. Our insurance is partnering with Medicare Part D for scripts. That ought to be fun... Mary

I am a responsible person who pple depend on me.I want my life back but in the intrum can there be any kindness?
You definately need a new doctor for sure... Mary
Oh my, willywills! Kindness should be automatic with ANY doctor! You should be treated with respect as well.
People with Non Cancer Chronic Pain are ultimately misunderstood and shamed or treated quite shabbily at times. If we don't have a cane or a wheelchair we MUST be addicts, right? WRONG.
Mary is right, you need a new doctor, a doctor who is kind and respectful and meets your needs. When you meet a new doc and she/he has none of those qualities, turn on your heal and walk right out the door. You don't need this bullsh*t! You need some understanding and compassion.
Wishing you only the best,
Mac
Asking questions and calling your pharmacist about substance control questions will send out red flags do not do that I repeat do not do that I’ve been red flagged and it is so hard for me I get Xanax and I’m only allowed to go to One pharmacy am I insurance gives me a hard time about everything
It depends on your insurance, the medication, and if the month has 31 days or 30. Would you care to share what type of medication it is, this info will help others answer your query?
I get hydrocodone 7.5 every month and have been for over a year. The pharmacy has always allowed me to pick them up at 28 days. This month i was told walgreens has a new pharmacist and wont allow until the 29th day. Is this a florida law now or just this pharmacist.
Sometimes it depends on your dr. I get my prescription every 28 days but the dr writes on the prescription do not fill until 30 days from date of last pick up. Which I find is stupid. My pharmacy isn't open on Saturday and Sunday so if 30 days falls on one of these days they give it to me on Friday so that I don't have to go without. Well my dr office checked and seen that this happened a couple months in a row so the last prescription I picked up had a hand written note on it saying that it may be refilled on or after a specific date which was on a Sunday which made me have to wait until Monday to be filled because you have to tell them at dr office which pharmacy you use and they will not allow you to go to a different pharmacy without first notifying them or they will kick you out of their program. Now tell me this isn't a bunch of stupid BS.
That is what I need to know!
Some months have 31 days, my pharmacy fills my narcotics 3 days early. Can I get them 4 days if I'm out?

I'm so confused and upset. I've been getting my prescription on the 29th day for over 3 years now. I go in today to get it, and I'm told they won't full it. I ask why and I'm told that it's illegal to fill it early. I explained that I've been doing it for years and have been told it was fine, also that if it's no longer fine then I won't do it anymore - but that I need it now because I ran out thinking that it'd be no problem like every month. She still told me no. I just don't understand. Now I'm starting to feel sick and I don't know what to do :(.
i filled my xanax on the 7th of sept. 2017 it is a 30 day perscription when can i pick my next perscription up
